eSafe Waiver Processing Time
An eSafe waiver application can be prepared and filed within 6 weeks.
After your waiver has been filed you will need to complete biometric processing at a designated e-Safe port of entry which includes having your photograph taken, being fingerprinted and possibly being asked to provide a DNA sample.
CBP increased the fee for i-192 applications on April 1, 2024, which will clear the backlog, and we anticipate will restore previous timeframes where applications were approved within 30 days from the date that biometrics were processed.
Update - Applicants that filed prior to the fee increase can expect processing times of up to 8 months, possibly longer. Those who filed after April 1, are seeing their applications approved within 60 days.
Processing time can be impacted by the type of charges and whether this is the applicant's first application.
FAQ: Pardons, Waivers & Records
How much does a pardon cost?
The Parole Board application fee is $50 and RCMP fingerprinting is approximately $75.
Our fee will depend on the amount of convictions on your record and number of cities you've resided in during the past 5 years.
How much does an e-Safe waiver cost?
Customs and Border Protection (CBP) charge US$1,100 and RCMP fingerprinting is approximately $75.
Our clients can expect to pay, on average, $750 for us to prepare, file and monitor the status of their e-Safe waiver application.
If I received my Canadian pardon do I need to apply for a US waiver?
Yes. CBP does not recognize a pardon. If you try to enter the US after you have been told you are inadmissible, you risk being banned or deported.
When am I eligible to apply for a pardon?
Determining eligibility can be confusing due to legislative changes and recent court rulings. Ultimately, eligibility depends on: when the most recent offence was committed, date when the sentence was fully completed and the nature of the offence(s).
Driving and weapon prohibitions are not considered part of your sentence when determining eligibility.
How soon after my conviction(s) can I apply for an eSafe waiver?
Unlike a pardon application there is no waiting period before you are eligible to apply, but enough time must pass to allow for reformation and rehabilitation. The severity of your past offence(s) will be a determining factor.
What is an e-Safe US waiver?
e-SAFE waivers refer to the online filing of either an I-192 or I-212 application with US Customs and Border Protection on the e-Safe website.
What exactly is an I-192 entry waiver?
A document granted by USCBP that allows entry to a non-immigrant under section 212(d)(3)(A)(ii) of the US Immigration and Nationality Act (INA) is referred to as a US entry waiver.
Anyone convicted of a drug offence, a crime involving moral turpitude or has multiple convictions for which the combined sentences to confinement exceeded five years, can apply for an entry waiver.
Other common crimes such as false pretences, fraud, possession of stolen property and theft are a few charges that will make you inadmissible, while charges for DUI and assault (sec. 266) won't cause you to be denied entry.
What criteria do US authorities consider when reviewing an eSafe application?
Your application is evaluated on your risk level, severity of your crimes and the reason for your entry. We carefully prepare your application to ensure that authorites see the person you are, not the person you were.
What if my charges resulted in a non-conviction?
You can apply for a file destruction to have the fingerprints and photographs that were taken as part of your arrest removed from the police database if your charges did not result in a conviction.

What is the difference between a pardon and a record suspension?
On March 13, 2012 the government's amendments to the CRA went into effect. Changes included a symbolic renaming from pardons to record suspensions, as well as increasing the time before an applicant is eligible to apply. Certain sexual offences and individuals convicted of more than three indictable offences and who received a prison sentence of two or more years were also deemed ineligible.
What documents are required for pardon / US waiver applications?
Whether you're applying for a Canadian pardon or an eSafe US waiver the lengthy and detailed list of documentation can include: RCMP criminal record, court information, local police records check(s), personally written statement, measurable benefit form, sworn affidavits, PBC and CBP application forms.
Additional documentation might be required depending on the applicant's circumstances.
What is the process involved for an e-Safe waiver renewal?
Permanent waivers are no longer issued. Your approved eSafe waiver will be valid for a maximum period of 5 years. At the appropriate time, we will begin your renewal which involves the same process as your first application.
